Terms of Service

1. Acceptance of Terms

By creating an account or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. User Accounts

You must be 13 years or older to create an account. You are responsible for safeguarding your account and for any activities or actions under your account. You agree to provide accurate and complete information when you create an account.

3. Use of Service

You agree not to use the Service for any illegal or unauthorized purpose, including generating content that is hateful, violent, harassing, or otherwise objectionable. We reserve the right to terminate accounts that violate these rules.

You are responsible for the content you generate and must ensure it complies with all applicable laws and regulations.

4. Subscriptions and Billing

4.1 Subscription Plans

We offer multiple subscription tiers (Free, Basic, Pro, Annual Pro) with different credit allocations and features. Current pricing is available on our Pricing page.

4.2 Billing Cycle

• Monthly subscriptions: Billed on the same day each month
• Annual subscriptions: Billed once per year
• Credits reset at the beginning of each billing cycle
• Unused monthly credits do NOT roll over to the next cycle

4.3 Payment Processing

All payments are processed through Creem, our secure payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel your subscription.

4.4 Price Changes

We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing cycle. You will be notified via email before any price change takes effect.

4.5 Failed Payments

If a payment fails, we will attempt to charge your payment method up to 3 times over a 10-day period. If all attempts fail, your subscription may be suspended or cancelled, and you will lose access to paid features.

5. Refund Policy

5.1 Subscription Refunds

• Monthly subscriptions: No refunds for partial months. You may cancel anytime and retain access until the end of your billing period.
• Annual subscriptions: Refunds available within 14 days of initial purchase only. After 14 days, no refunds will be issued.

5.2 Credit Purchases

One-time credit purchases are non-refundable once credits are added to your account.

5.3 Refund Exceptions

We may issue refunds at our discretion for:

• Technical issues preventing service use
• Duplicate charges
• Unauthorized charges (subject to verification)

5.4 Requesting a Refund

To request a refund, contact us at xuhuan798@gmail.com with your transaction details. Refunds are processed within 5-10 business days to your original payment method.

6. Cancellation Policy

6.1 How to Cancel

You can cancel your subscription anytime through:

• Your account dashboard (Subscription Management)
• Contacting our support team at xuhuan798@gmail.com

6.2 Effect of Cancellation

• Access continues until the end of your current billing period
• No further charges will be made
• Your credits will remain available until the billing period ends
• After cancellation, your account reverts to the Free plan

6.3 Reactivation

You may reactivate your subscription at any time by selecting a new plan. Previous unused credits from cancelled subscriptions do not carry over.

7. Credits System

7.1 Credit Allocation

• Free plan: 20 credits upon signup
• Paid plans: Credits allocated monthly as per your plan
• Additional credits: Available for purchase as needed

7.2 Credit Usage

• 1 image = 1 credit (single generation)
• 4 images = 4 credits (batch generation)
• Credits are deducted immediately upon successful generation

7.3 Credit Expiration

• Monthly subscription credits: Expire at the end of each billing cycle
• Purchased credit packs: Never expire
• Free trial credits: Never expire

7.4 No Cash Value

Credits have no cash value and cannot be transferred, sold, exchanged for cash, or refunded.

8. Commercial Use and Licensing

8.1 Free Plan

Images generated on the free plan are for personal, non-commercial use only. Images will include a watermark.

8.2 Paid Plans

Paid subscribers (Basic, Pro, Annual Pro) receive a commercial license to use generated images for:

• Commercial projects and business use
• Client work and commissioned projects
• Products for sale (physical or digital)
• Marketing and advertising materials
• Social media content

8.3 Restrictions

You may NOT:

• Resell or redistribute the raw AI-generated images as stock images or templates
• Claim exclusive copyright over the AI-generated images
• Use images for illegal, harmful, defamatory, or offensive purposes
• Generate content that violates others' intellectual property rights

8.4 Attribution

Attribution is appreciated but not required for paid plan users.

9. Content Ownership

You retain ownership of the prompts you create. You grant us a license to use your prompts to generate images and operate the service. The ownership of AI-generated images can be complex and depends on copyright law in your jurisdiction. We make no warranties regarding copyright ownership of generated images.

10. Dispute Resolution

10.1 Contact First

Before initiating any formal dispute, please contact us at xuhuan798@gmail.com to resolve the issue. We are committed to working with you to find a fair resolution.

10.2 Chargebacks

Initiating a chargeback without contacting us first may result in immediate account suspension. We will work with you to resolve billing issues fairly and promptly.

10.3 Governing Law

These Terms are governed by and construed in accordance with applicable international laws. Any disputes will be resolved through good faith negotiations.

11. Disclaimer

The service is provided "as is" without any warranties, express or implied. We are not liable for any damages or losses resulting from your use of our service. The AI may sometimes generate inaccurate or offensive content that does not represent our views. You use the service at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, artifycolor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
